These Terms of Service govern your use of Fixure's vulnerability management platform and related services.

By using Fixure's services, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree to these terms, you may not use our services.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Fixure, Inc. ("Fixure," "we," "us," or "our") regarding your use of our vulnerability management platform, including our website, software applications, and related services (collectively, the "Services").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

Fixure provides an AI-powered vulnerability management platform that consolidates security data from multiple tools, applies intelligent deduplication, and provides unified reporting and compliance capabilities.

Our Services include:

  • Unified Signal Layer for vulnerability data normalization
  • AI-powered deduplication and correlation
  • Smart assignment and tracking workflows
  • Compliance reporting and audit trails
  • Integration with third-party security tools
  • Dashboard and analytics capabilities

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We may also impose limits on certain features or restrict access to parts or all of the Services without notice or liability.

3. User Accounts and Registration

To access certain features of our Services, you must register for an account. When registering, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring compliance with your organization's security policies

You may not share your account credentials or allow others to use your account. Accounts are non-transferable and may not be sold, traded, or transferred to another party.

4. Data Security and Privacy

We take data security seriously and implement industry-standard measures to protect your information. Our privacy practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference.

Key security commitments:

  • Encryption of data in transit and at rest
  • Regular security assessments and penetration testing
  • SOC 2 Type II compliance
  • Limited access controls and monitoring
  • Incident response and breach notification procedures

You retain ownership of your data. We will not access, use, or disclose your data except as necessary to provide the Services or as required by law.

5. Acceptable Use Policy

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable laws, regulations, or third-party rights
  • Use the Services to transmit harmful, offensive, or illegal content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Services or servers connected to the Services
  • Use automated means to access the Services without our express written permission
  • Reverse engineer, decompile, or attempt to extract source code from the Services
  • Use the Services to compete with us or develop competing products

We reserve the right to suspend or terminate your access to the Services if we believe you have violated this Acceptable Use Policy.

6. Payment Terms

Our Services are provided on a subscription basis. Pricing is as specified in your subscription agreement or as posted on our website. All fees are non-refundable unless otherwise specified.

Payment terms:

  • Fees are payable in advance for each subscription period
  • We accept major credit cards and ACH payments
  • Subscription fees will automatically renew unless cancelled
  • Price changes require 30 days advance notice
  • Overdue accounts may result in service suspension

We may offer free trials or beta access at our discretion. These may be subject to additional terms and conditions.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXURE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO FIXURE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

8. Term and Termination

These Terms remain effective until terminated by either party. You may terminate your account at any time by contacting us or using the account cancellation feature in the Services.

We may terminate or suspend your access immediately, without prior notice, if you breach these Terms or engage in conduct that we believe is harmful to other users, us, or third parties.

Upon termination:

  • Your right to access and use the Services will cease immediately
  • We will provide you with a reasonable opportunity to export your data
  • We may delete your data after a reasonable retention period
  • Accrued payment obligations will survive termination
